Abstract

This, the first part of a two-part article, presents a review of personal injury cases decided since the Queen's Bench Division decision in Conner v Bradman & Co Ltd in which the courts have applied the revised reduction factor adjustments in the Sixth Edition of the Ogden Tables for categories other than mortality. Evaluates the approaches to the adjustments in 11 decisions, notes judicial misunderstandings of the reasoning underpinning the reduction factors, and suggests why the next edition of Ogden should contain additional guidance on when departures from the factors are justified.
